1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your access to and use of the website operated by Textority LLC ("Textority™", "we", "our", or "us"), including the reservation of URLs and related early access features available through textority.com and associated domains (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old to use the Service. If you are between 13 and 18 years old, you may use the Service only with the consent of a parent or legal guardian. The Service is not intended for individuals under the age of 13.
3. Nature of the Service
Textority™ provides an early stage service that allows users to request the reservation of a URL within the Textority™ ecosystem.
The Service currently enables:
- Submission of a non binding request to reserve a URL
- Collection of contact information for early access communication
The Service does not currently provide ownership, activation, hosting, publishing, or guaranteed availability of any URL.
4. URL Reservation and Licensing
4.1 No Ownership
All URLs, usernames, handles, and identifiers made available through the Service are and remain the exclusive property of Textority LLC.
Reserving a URL:
- Does not grant ownership
- Does not grant intellectual property rights
- Does not grant trademark rights
- Does not guarantee activation or future availability
4.2 Reservation Is Non Binding
Submitting a reservation request is a non binding expression of interest and does not constitute acceptance, assignment, or licensing of any URL.
Textority™ retains sole discretion to approve, deny, modify, suspend, or revoke any reservation request.
4.3 License Characteristics (If Activated)
If Textority™ activates a reserved URL in the future, any access granted will be provided as a license that is:
- Limited
- Non exclusive
- Non transferable
- Revocable
- Not perpetual
The license remains conditional upon compliance with these Terms and applicable law.
5. Textority™'s Right to Protect the Platform
To protect the integrity, safety, and reputation of the Service, Textority™ may, at its sole discretion:
- Reclaim, reassign, modify, or revoke any reserved or activated URL
- Deny or remove reservations that pose legal, reputational, or operational risk
- Restrict or suspend access to the Service
This includes, but is not limited to, URLs that:
- Impersonate or misrepresent individuals, brands, or entities
- Infringe intellectual property or other rights
- Are reserved for resale, trafficking, or name squatting
- Are misleading, abusive, harmful, or illegal
- Could reasonably cause confusion or harm to users or Textority™
Textority™ is not liable for any loss resulting from such actions, to the maximum extent permitted by law.
6. Acceptable Use
You agree not to use the Service to:
- Violate any law or regulation
- Misrepresent identity or affiliation
- Infringe intellectual property or privacy rights
- Interfere with the operation or security of the Service
- Submit false, deceptive, or abusive reservation requests
Textority™ may investigate and take appropriate action for violations.
7. Intellectual Property
The Service, including its design, content, code, trademarks, logos, and all related materials, is owned by Textority LLC or its licensors and is protected by applicable intellectual property laws.
No rights are granted to you except the limited right to access and use the Service as expressly permitted by these Terms.
8. Trademark Notice
Textority™ is a trademark of Textority LLC. All other names, logos, or marks appearing on the Service are the property of their respective owners.
9. Communications
By submitting your email address or contact information, you consent to receive communications from Textority™ related to:
- Your URL reservation
- Early access updates
- Service related announcements
You may opt out of non essential communications at any time.
10. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis.
To the maximum extent permitted by law, Textority™ disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non infringement.
Textority™ does not guarantee that the Service or any reserved URL will be available, activated, uninterrupted, or error free.
11. Limitation of Liability
To the maximum extent permitted by law:
- Textority™ shall not be liable for indirect, incidental, consequential, special, or punitive damages
- Textority™ is not liable for loss of data, business, goodwill, or reputational harm
- Textority™ is not liable for decisions related to URL reservation, licensing, revocation, or reassignment
If liability is found, Textority™'s total liability shall not exceed the amount paid by you to Textority™, if any, or one hundred U.S. dollars, whichever is greater.
12. Indemnification
You agree to indemnify, defend, and hold harmless Textority LLC and its officers, employees, contractors, and affiliates from any claims, damages, losses, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your reservation requests or submitted information
13. Termination
Textority™ may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or created risk or harm to the Service or its users.
Upon termination, any reservation or license associated with you may be revoked or reassigned.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
Any dispute arising from or related to these Terms or the Service shall be resolved exclusively in state or federal courts located in Miami Dade County, Florida, and you consent to personal jurisdiction in such courts.
15. Changes to These Terms
We may update these Terms at any time. Updates will be posted on this page with a revised date. Continued use of the Service constitutes acceptance of the updated Terms.
